Party wall agreements without the jargon

When you need one, what it costs, how long it takes, and what happens if your neighbour objects.

Separate from planning, and often forgotten

The Party Wall etc. Act 1996 is nothing to do with planning permission. You can have full permission and still be unable to start because you have not served notice.

When you need one

  • Building on or at the boundary line
  • Excavating within three metres of a neighbour's structure, below their foundation depth
  • Cutting into, raising or removing a shared wall

Which covers most rear extensions on terraced and semi detached houses.

What it costs and how long

If your neighbour consents in writing, nothing but the notice. If they dissent, each side appoints a surveyor, or you share one, and an award is drawn up. Budget one to two thousand pounds per neighbour and four to eight weeks.

Serve early

Two months notice is required for most works. Serving at the same time as your planning application means the two clocks run together instead of one after the other.

Does this apply to your house?

Reading the rules is one thing. The Project Calculator applies them to your house and shows you the answer as a drawing, with the cost alongside.
